Focused on equity, innovation, and economic empowerment, DIT TECH’s comprehensive offerings include career pathway development, internships, and work-based learning programs to support transitions into sustainable careers.We are seeking a high-level Federal Litigator with a specialized focus on DOL WIOA (Workforce Innovation and Opportunity Act) regulations and 42 U.S.C. § 1981 civil rights litigation. This is not a standard "wrongful termination" case. We are prosecuting a sophisticated federal matter involving a government grant recipient, documented administrative fraud, and systemic gatekeeping.The ideal candidate will move beyond Title VII frameworks and execute an aggressive, multi-front strategy that leverages federal grant compliance and False Claims Act (FCA) principles to secure uncapped punitive damages.Required Core Skillset & ExpertiseWIOA Section 188 Specialist: Mastery of 29 CFR Part 38. You must understand the "Assurance of Compliance" required of WIOA Title I recipients and have the capacity to file and manage complaints with the DOL Civil Rights Center (CRC).Section 1981 Federal Litigator: Proven track record in U.S. District Court for Section 1981 claims. You must demonstrate an ability to establish "But-For" causation and intentional discrimination without the constraints of damage caps.Administrative Fraud & Pretext Mastery: Expert-level ability to apply the St. Mary's Honor Center v. Hicks standard. You must be able to convert documented "mendacity" (lies told to state agencies like DOES) into evidence of "Malice and Reckless Indifference."Federal Grant Law (2 CFR 200): Understanding of the Uniform Guidance and how a recipient’s certification of compliance constitutes a False Claim if retaliation or discrimination is present.Key ResponsibilitiesStrategic Prosecution: Draft and file a Federal Complaint bridging Section 1981 personal damages with WIOA Section 188 regulatory violations.Evidence Leveraging: Strategically deploy "smoking gun" documentation (emails/administrative rulings) to prove pretext and defeat Summary Judgment.Regulatory Pressure: Execute a parallel strategy involving the DOL OIG and Civil Rights Center to challenge the defendant's federal funding eligibility.Gatekeeping Litigation: Advise on legal pathways to challenge "funding caps" and discriminatory gatekeeping by Local Workforce Boards and Housing Authorities.Candidate QualificationsJuris Doctor (JD) from an accredited law school.Active Bar membership in Washington, D.C. and/or Maryland.Minimum 7+ years of experience in Federal Regulatory Litigation or Whistleblower/FCA Law.DO NOT APPLY if your primary experience is in Pharmaceutical Torts, Toxic Torts, or standard retail Employment Law. We require a strategist who understands Federal Grant Compliance.
