We invest in one another's success, fostering both individual growth and collective achievement in service of our clients.About the PracticeThe Health Law Practice Group represents a diverse range of healthcare providers, including individual physicians, physician group practices, ambulatory surgery centers, specialty hospitals, and other healthcare facilities. The practice also represents individual providers in professional discipline matters before state licensing boards. This role does not involve personal injury litigation or medical malpractice defense.ResponsibilitiesAdvise physicians, physician groups, ASCs, specialty hospitals, and other healthcare providers on regulatory compliance, including Stark Law (Physician Self-Referral Law), the Anti-Kickback Statute, and False Claims Act mattersStructure, draft, and negotiate physician employment agreements, professional services agreements, medical director agreements, and joint venture arrangements with attention to healthcare regulatory requirementsCounsel clients on Medicare reimbursement rules and regulations, including conditions of participation, billing compliance, and payor contracting considerationsAdvise on HIPAA compliance, healthcare privacy and data security requirements, breach response protocols, and related state privacy lawsAnalyze and advise on corporate governance, organizational structure, and operational compliance for healthcare entitiesRepresent individual healthcare providers in professional discipline matters before the Nebraska Department of Health and Human Services and other state licensing boards, including matters involving:-Professional licensure investigations and proceedings-Medical staff credentialing and privileging disputes-Peer review and fair hearing proceedings-Hospital and health system employment matters-Graduate medical education program disputes-Conduct due diligence and provide regulatory analysis for healthcare transactions, including acquisitions, affiliations, and practice formations-Develop and maintain strong client relationships, serving as a trusted advisor and contributing to practice group development initiativesQualificationsJuris Doctor from an ABA-accredited law school with a strong academic recordMinimum of 6 years of health law experience in a law firm setting, with substantial exposure to provider-side regulatory and transactional mattersDemonstrated knowledge of federal healthcare regulatory frameworks, including the Stark Law (Physician Self-Referral Law), Anti-Kickback Statute, False Claims Act, and HIPAA privacy and security requirementsWorking knowledge of Medicare rules and reimbursement regulations, including conditions of participation and billing compliance requirementsFamiliarity with Nebraska state medical licensing statutes and regulations; experience with other state licensing frameworks is preferredExperience advising physicians, physician groups, ambulatory surgery centers, and other healthcare providers on regulatory compliance and transactional mattersExcellent written and oral communication skills, with the ability to distill complex regulatory issues into clear, actionable guidance for clientsStrong analytical and problem-solving abilities, with sound judgment and meticulous attention to detailProven ability to manage multiple matters and priorities while maintaining high-quality work product under deadlinesCollegial, team-oriented approach with a commitment to mentoring junior attorneys and contributing to a collaborative practice environmentActive bar membership in Nebraska, or eligibility for admission to the Nebraska barWhat Koley Jessen OffersA collegial, people-focused culture that values collaboration and professional excellenceMeaningful opportunities for professional growth, client development, and advancement within the practice groupOngoing professional development programs and continuing legal education supportCompetitive compensation commensurate with experience, plus a comprehensive benefits package including medical, dental, vision, life, and long-term disability insurance; 401(k) with firm contribution; and employee wellness programsModern office facilities in a convenient central Omaha locationKoley Jessen is an Equal Opportunity Employer and is committed to fostering an inclusive workplace.
