Position SummaryAt the direction of the Executive Director, the Director, Contract Management and Compliance performs highly responsible and visible administrative and professional work negotiating, documenting and administering operational, funding and development agreements between the Solid Waste Authority and private entities, other governmental and not-for-profit agencies to include conducting negotiations, researching statutory and other legal requirement to enter into such agreements, identifying all laws governing the transaction, preparing and drafting agreements and related documents, making presentations to governing authorities and administering the agreements throughout their term. Work requires considerable independent judgment and decision making.Essential Functions & Knowledge, Skills And AbilitiesOther duties may be assigned.Drafts contracts, service and other agreements, agenda items, procurement documents and other documents. Reviews agreements for accuracy, quality and consistency with federal, state and local laws and regulations, as well as, the Authority’s policies and procedures. Ensures compliance with legal guidelines and contracting principles.Assists Executive staff with development of administrative policies and procedures which are compliant with laws and other relevant legal concerns. Negotiates documents and administers agreements with other governmental entities on behalf of the Authority. Assists in drafting and reviewing operating agreements with facility contract operators and amendments as needed Negotiates documents and administers use and special event permits for activities by other private and governmental entities. Prepares and implements Interlocal Agreements (ILA) with other governmental entities.KNOWLEDGE, SKILLS AND ABILITYRequirementsTo perform this job successfully, an individual must be able to perform each essential duty satisfactorily. The position requires:Considerable knowledge of federal, state and local laws pertaining to contracts and contract compliance. Considerable knowledge of constitutional, common, administrative and statutory law of Florida relevant to Florida local government and to any assigned practice areas, as well as relevant federal constitutional, common, administrative and statutory law. Considerable knowledge of contract management principles and practices. Considerable knowledge of the functions, organizations and administration of governmental organizations. Knowledge of all relevant ethical and legal rules governing the practice of law and the conduct of attorneys, including the Rules Regulating the Florida Bar. Considerable knowledge of the methods and techniques relevant to effective legal research, and skill in identifying and analyzing information, and ability to express sound judgments based upon findings. This includes firm working knowledge of the use of on line research products such as Westlaw and Lexis, as well as traditional paper case reporters, legal encyclopedias, digests, and the like. Reviews, interprets and provides legal advice on stated and federal legislation and regulations applicable to the Authority. Extensive knowledge of the Florida public records law and Government in the Sunshine requirements. Ability to research and to compile information of a technical and complex manner. Knowledge of computer software applications including word processing and spreadsheets. Ability to analyze and interpret contract documents furnished in written, oral diagram or schedule form. Ability to establish and maintain effective working relationships with staff, elected officials, staff of other governmental entities and regulatory agencies, users and the public. Ability to handle multiple concurrent tasks and responsibilities. Ability to communicate effectively both orally and in writing, prepare and present complex reports and presentations to top management, public groups, and/or boards of directors.Ability to solve practical problems and deal with a variety of concrete variables in situations where only limited standardization exists. Ability to apply advanced mathematical concepts such as exponents, logarithms, quadratic equations, and permutations. Ability to apply mathematical operations to such tasks as frequency distribution, determination of test reliability and validity, analysis of variance, correlation techniques, sampling theory, and factor analysis.Education, Experience, Certificates and LicensesThe ideal candidate possesses the education and experience listed belowGraduation from an accredited college or university with major course work in Law, Finance, Business Administration/Management or Public Administrationminimum five (5) years of responsible experience in negotiating, drafting and/or administering governmental contracts. Juris Doctorate (J.D.) degree.
