Litigation Attorney
The Litigation Attorney is a key member of the Litigation Section within the AOPC Legal Department, representing judges, magisterial district judges, court administrators, and other judicial officials and agencies in lawsuits arising from their official duties. This advanced counsel position requires strategic, independent management of complex legal matters, with the attorney recognized as an expert in their legal specialty. The position offers flexibility to be based in either Philadelphia or Harrisburg, and the selected candidate may be eligible to telework up to two days per week after completing required training and demonstrating a secure internet connection. State government position.Two telework days per week are available after a training period.13 paid holidays, 12 paid sick days, and 12+ paid vacation days per year.Comprehensive, low-cost medical, dental, vision, and prescription plans for employees and eligible family members on the 1st day of employment.Salary increases, student loan forgiveness plans, employee assistance programs, and State retirement plans.6 weeks of paid parental leave for eligible employees.Healthcare Flexible Spending AccountJob DutiesIndependently drafts responses to lawsuits, such as motions to dismiss, answers and affirmative defenses, motions for summary judgment, preliminary objections, motions to quash, and memoranda of law.Provides legal advice to clients on a wide range of issues, including employment matters, to proactively prevent litigation.Conducts legal research using both electronic databases and traditional research tools.Independently develops and implements theory of case; interviews clients and witnesses, and advises litigation clients.Presents and argues motions in both state and federal courts.Responds to complaints before federal and state agencies (i.e., EEOC, DOJ, Court of Claims, Unemployment Compensation) by investigating claims and compiling documentation.Responds to subpoenas for documents or testimony, and files motions to quash when appropriate.Propounds and responds to discovery requests.Drafts briefs for the Third Circuit Court of Appeals and state appellate courts, and presents oral arguments as needed.Negotiates and finalizes settlements, and participates in mediations to achieve favorable outcomes.Prepares witnesses for trial in both state and federal courts; files pretrial memoranda, conducts voir dire, and prepares proposed jury instructions, findings of fact and conclusions of law, motions in limine, memoranda of law, and all documents necessary for trial.Conducts trials and handles post-trial motions and appeals as necessary.Occasional overnight travel may be required.Minimum QualificationsGraduation from an ABA-approved law school.Admission to, and continual good standing with, the Bar of the Supreme Court of Pennsylvania, PLUSThree years of progressively responsible legal experience, including substantial work in highly responsible and complex professional legal matters.Additional Requirements/PreferencesLitigation experience in the federal courts preferred.Excellent oral and written communication skills required.Satisfactory criminal background check required.Salary informationStarting Annual Salary$80,606 - $97,123
