Sr. Counsel, Real Estate
Overview***This position is US - remote eligible***The Sr. Counsel, Real Estate analyzes, drafts, negotiates, and provides advice relating to all facets of the real property owned and leased by the Company. From time to time, the attorney will also work on the acquisition of properties for new restaurants. Counsel interfaces with members of the Asset Management, Facilities, Operations, Tax and Property Accounting teams, as well as other members of the Legal team. Counsel will communicate with landlords, developers and neighboring property owners, or their respective counsel.RESPONSIBILITIESAnalyze and provide advice with respect to Company's real estate portfolio (e.g., leases, surveys, easements, declarations, eminent domain, environmental matters); includes determining rights and obligations regarding maintenance, use, alterations, indemnities, areas of responsibility and CAM payments; responding to inquiries regarding insurance and indemnity requirements under relevant documentsApply innovative problem-solving skills in developing strategic solutions; includes providing legal advice and applying sound business judgment in a fast-paced, high-demand environmentNegotiate and draft documents; draft and respond to legal notices (e.g., non-disturbance agreements, lease amendments, easements, default notices).Jointly maintain property management databases with other usersManage lease renewal process, including accurately identifying term expirations, renewal notice deadlines, and other material deadlines, in collaboration with Asset ManagementEffectively manage outside counsel when retainedBe an effective resource for the real estate teamAssist with special projects and training of othersREQUIRED TECHNICAL SKILLSMinimum 7 years of law firm or in-house experience as a real estate attorney with emphasis on commercial real estate transactions, including leasingLicensed to practice law and in good standing under the Bar of of any state that enables admission to practice as in-house counsel in Florida REQUIRED EDUCATION Juris Doctor Degree from an ABA accredited law school OTHER KEY QUALIFICATIONS Excellent communication, document drafting and organizational skillsAbility to build and maintain strong relationships with a variety of in-house clients, peers and subordinates, and interact effectively with third partiesDemonstrated ability to independently make decisions regarding complex property documents with an in-depth understanding of the risks involvedDemonstrated strong initiative and ability to handle multiple projects in a fast-paced environmentProven analytical ability to recognize and creatively resolve issues
