Summary Of WorkWhile this position offers the potential for remote work within North Dakota, we prefer the candidate to work in person at our Bismarck office during the probationary period to support onboarding and team integration.This position is responsible for collaborating with Insurance Department staff, criminal and civil investigators, and fellow attorneys to:Prepare administrative and criminal cases for enforcement and prosecutionProvide legal advice and opinions for the Commissioner, Deputy Commissioner, and other Department employeesAdvise agency staff on legal mattersDraft legislation and legal documentsRepresent the Department in administrative hearings, legislative hearings, and civil courtThis position is under the direction of the Department's General Counsel to provide a wide variety of legal support to the Department staff members. The ideal candidate for this position must enjoy collaborating and interacting with civil and criminal investigators, non-attorney subject matter experts, consumer protection professionals, and other attorneys. The Department values the ability to develop strong working relationships and collaborative work that produces optimum results.***Applicants are encouraged to apply early, as interviews may be conducted before the application deadline.***Salary Range for the position is $85,000 - $115,000 and will depend on experience.Duties and Tasks Collaborate with Department staff, criminal and civil investigators, and fellow attorneys to prepare administrative and criminal cases for enforcement and prosecutionEducate Department staff about the law concerning insurance fraud and the business of insurance, and act as an insurance and criminal law resourceEstablish and maintain working relationships with the judiciary, other attorneys, county officials, and law enforcementInvestigate, perform legal analyses, and summarize and brief insurance agent and company regulatory violationsConduct legal research relating to insurance fraud, the business of insurance, and administrative agency regulationsRespond to insurance regulation inquiries from the public, the insurance industry, and othersRespond to legal inquiries from North Dakota legislators and legislative council, and represent the Department during the regular legislative session and interim session at hearings and committee meetingsDraft and assist other Department staff in drafting legislation and administrative rulesDraft legal opinions, pleadings, motions, briefs, orders, search warrants, settlement agreements, and other legal documentsRepresent the Department and State in civil court, and administrative hearings in a competent, effective, and ethical mannerNegotiate and settle civil, and administrative complaintsAssist with regulatory examinations of insurance companiesCoordinate work with state's attorneys, insurance regulators in other states, other North Dakota agencies, and federal agenciesKeep up to date on state and federal insurance issues, case law, regulations, and practicesParticipate in national committee conference calls and meetings, including possible travel to national insurance regulation conferences and meetingsEngage in education and training courses to become a competent insurance regulation resourcePerform other duties as necessary and/or assigned by the Commissioner, Deputy Commissioner, and General Counsel Minimum QualificationsA Juris Doctorate degreeAdmitted to North Dakota Bar or eligible for North Dakota Bar admission by motionHigh ethical standards and a positive personnel historyExcellent written and verbal communication skills Preferred QualificationsPreferred Experience or Demonstrate Ability to Learn Related Subject Matter:Knowledge and application of state and federal regulatory lawWestLaw researchLegislative draftingStrong interpersonal skills needed to work well with clients, colleagues, government officials, and the publicGood judgment, strong reliability, and a willingness to devote time and energy necessary to provide excellent services to the Insurance Commissioner and staff membersExcellent time management and organization skillsExperience with criminal law may be given preference About Team ND"Far and away the best prize life offers is the chance to work hard at work worth doing." - Theodore RooseveltMore than 7,500 talented, hard-working people across sixty-three agencies have come together as Team North Dakota.
